LIMITED LIFETIME WARRANTY POLICY

FORTE TRVL warranty policy is applicable to all orders placed after January 01 2024, please refer to this page.

Our commitment includes a lifetime warranty that encompasses repairs or replacements for functional damages, addressing issues that impede the product's utility. Should your item exhibit functional damage, we will evaluate and offer either repair or replacement services.

This coverage extends to all stitching, zippers, metalwork, and handles. It's important to note that this warranty excludes natural aging of materials and regular wear and tear.

However, our lifetime guarantee does not extend to cosmetic wear and tear, misuse or abuse, or damages resulting from negligence.

AIRLINE DAMAGE

In cases of airline damage, it's typically necessary to report claims to the airline within a specific timeframe. Therefore, we recommend promptly contacting the airline in such instances. If you encounter difficulties in obtaining compensation or if the airline fails to respond within 14 days, please reach out to us, and we will endeavour to assist you.

A. PRODUCTS COVERED BY THIS LIMITED WARRANTY

This limited warranty applies to all luggage manufactured by FORTE TRVL and purchased directly from FORTE TRVL. The luggage is intended for travel by air, car, train, boat, and foot. This Warranty excludes coverage if the luggage is used in a manner inconsistent with its intended design.

B. WHO THIS WARRANTY EXTENDS TO

This limited warranty extends to the original purchaser of any luggage or, if the luggage was received as a gift, to the original recipient. The "original purchaser" is the first buyer of the luggage from FORTE TRVL. The "original recipient" is the first person to receive the luggage as a gift from FORTE TRVL. All FORTE TRVL warranties, including implied warranties, are valid only for the duration of ownership by the original purchaser/recipient of the luggage. A COPY OF THE PURCHASE RECEIPT IS REQUIRED TO DETERMINE WARRANTY ELIGIBILITY.

FORTE TRVL limited warranties are non-transferable and do not apply to commercial or rental use of the luggage.

C. FORTE TRVL LIMITED WARRANTY AND RESPONSIBILITIES FORTE TRVL

warrants the luggage, when used normally for its intended purposes, against defects in material and workmanship as described below ("Defects") for the lifetime of the luggage.

D. WHAT THIS LIMITED LIFETIME WARRANTY COVERS THIS LIMITED WARRANTY APPLIES TO THE FOLLOWING DEFECTS:

Cracks or fractures in the shell Failure of wheels, handles, or telescoping handles THIS LIMITED WARRANTY DOES NOT COVER THE FOLLOWING:

"Cosmetic Damage," including scratches, dents, scuffs, stains, colour changes, normal wear and tear, technological obsolescence, or other non-functional changes in appearance that occur during normal use and handling of the luggage and do not impair its functionality. Aluminium luggage is particularly susceptible to Cosmetic Damage. Replacement of non-defective components in the luggage. For example, if only one component of the luggage is defective in a set, only that component will be replaced. Luggage sold in "as-is," "preconditioned," "reconditioned," "used," "comfort return," "returned," "previously owned," or similar conditions indicating it is not "new" or of "first quality," or has been purchased or used by another consumer. Loss of functionality due to being locked out of the luggage. See "Your Responsibilities" below for assistance with locked luggage. In the event of a Defect, FORTE TRVL's sole liability and your sole remedy under this limited warranty will be, at FORTE TRVL's discretion, to repair or replace the luggage, subject to fulfilment of "Your Responsibilities" below. Replacement luggage may be provided in a different colour from the original purchase. For limited edition, discontinued, or out-of-stock luggage covered under the limited warranty, FORTE TRVL only guarantees replacement with a product of equal or greater retail value and does not guarantee an exact replacement of the same limited edition, discontinued, or out-of-stock item.

E. YOUR RESPONSIBILITIES

To benefit from this limited warranty in case of a Defect, you must return your luggage to FORTE TRVL and provide proof of the original purchase date. You will not be responsible for shipping costs to return your luggage. Evidence of a Defect and any claims must be sent to the support email address provided at the end of this limited warranty.

FORTE TRVL will repair or replace (as applicable) and return your luggage within 90 days of receiving your original luggage. You will not be responsible for shipping costs associated with shipping replaced or repaired luggage to addresses within the UK. Shipping charges for addresses outside the UK will be provided after submission of a warranty request. Replaced or repaired luggage is subject to the same limited warranty as the original.

Locked luggage can be shipped to FORTE TRVL for unlocking by FORTE TRVL personnel. You will be responsible for any shipping and handling costs.

F. DISCLAIMER

LIMITATION ON LIABILITY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE LUGGAGE IS PROVIDED "AS IS," AND THIS WARRANTY, ALONG WITH ANY IMPLIED WARRANTIES, ARE YOUR EXCLUSIVE WARRANTIES AND REPLACE ALL OTHER WARRANTIES OR CONDITIONS, EXPRESS OR IMPLIED. SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU. YOU MAY ALSO HAVE OTHER RIGHTS THAT VARY FROM JURISDICTION TO JURISDICTION. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW AND EXCEPT AS SET FORTH IN THIS LIMITED WARRANTY, IN NO EVENT WILL FORTE TRVL OR ITS SUPPLIERS BE LIABLE FOR PROCUREMENT OF SUBSTITUTE PRODUCTS OR OTHER SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR INDIRECT DAMAGES ARISING OUT OF OR RELATED TO THE LUGGAGE OR ITS USE BY YOU OR ANY THIRD PARTY, WHETHER UNDER THEORY OF CONTRACT, TORT (INCLUDING NEGLIGENCE), INDEMNITY, PRODUCT LIABILITY, OR OTHERWISE. THIS LIMITATION WILL APPLY EVEN IF FORTE TRVL HAS BEEN ADVISED OF SUCH DAMAGES AND NOTWITHSTANDING THE FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY. FORTE TRVL'S TOTAL LIABILITY WILL NOT EXCEED THE PURCHASE PRICE PAID FOR THE LUGGAGE GIVING RISE TO SUCH LIABILITY. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS AND EXCLUSIONS MAY NOT APPLY TO YOU.

G. ARBITRATION

G1. In the event of a dispute arising between you and FORTE TRVL concerning this Limited Warranty ("Dispute"), such Dispute will be resolved solely through binding individual arbitration and not in a class, representative, or consolidated action or proceeding. Both parties agree that the Arbitration Act 1996 governs the interpretation and enforcement of this Limited Warranty, and that you and FORTE TRVL waive the right to a trial by jury or to participate in a class action.

G2. Subject to limited exceptions to Section G1 above: (i) you may seek resolution of a Dispute in small claims court if it qualifies; and (ii) both parties retain the right to seek injunctive or other equitable relief from a court to prevent (or enjoin) the infringement or misappropriation of intellectual property rights.

G3. Arbitration will be conducted by the London Court of International Arbitration (LCIA) under its Arbitration Rules (the “LCIA Rules”) then in effect, unless modified by this Limited Warranty. The LCIA Rules are available at www.lcia.org. A party initiating arbitration must submit a written Notice of Arbitration to the LCIA and provide notice to the other party as specified in the LCIA Rules. The LCIA provides a form Notice of Arbitration at www.lcia.org. If your claim is for £10,000 or less, you may choose whether arbitration will be conducted solely on the basis of documents submitted to the arbitrator, through a telephonic or video-conference hearing, or by an in-person hearing, as determined by the LCIA Rules. If your claim exceeds £10,000, the right to a hearing will be determined by the LCIA Rules. Any arbitration hearings will take place in London, UK, unless both parties agree to a different location. The arbitrator will have exclusive authority to decide all issues relating to the interpretation, applicability, enforceability, and scope of this arbitration agreement.
